Protect My Website Idea

I have unique idea for a website and I want to get some website pricing, but I do not want to give away my idea. How can I protect my new concept and get a web design company to give me some pricing?

Before you contact any website designers, you will need to provide each one you contact a Non Disclosure Agreement (NDA).

A NDA will create a legal framework under which you can disclose as much about your concept to a prospective vendor as you need to, and be protected, even if you later decide not to work together.

Make sure the NDA you use is clear and easy to read and understand.

You should provide a NDA that you sign and date to each website designer, then have them sign and date and return to you via fax or mail, or an email attachment. After you receive the signed NDA back from your website designer, then you can begin the process of sending out a Request For Quote (RFQ) or some preliminary information to initiate a discussion between the two parties.

Tips:

  • Acquire a well-written Non-Disclosure Agreement before sharing any information, documents or discussing your idea with website designers, programmrs and others.
  • Avoid finding and using generic NDA documents from the internet—they may be poorly written and may offer little protection.
  • Email and/or fax your NDA to those you need to share details of your website idea with, and make sure you received a signed copy back from the other party before proceeding with any discussions.
  • If possible, do as much prelimnary work on your project without sharing information.
  • Have your lawyer review any NDA you create or modify before using it.
